1. Acceptance of Terms

By accessing or using Dashfeed (the “Service”), operated by Oblik LLC (“we,” “our,” or “us”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

Dashfeed is an analytics and insights platform available at dashfeed.ai. The Service allows users to connect data sources, create dashboards, track metrics, and receive AI-powered insights. We may update, modify, or discontinue features of the Service at any time.

3. Accounts and Registration

To use the Service, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.

4. Workspaces and Access

The Service is organized into workspaces. Workspace administrators control member access, roles, and permissions. You agree to comply with your workspace's policies and the access level assigned to you.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to the Service or its related systems
  • Interfere with or disrupt the integrity or performance of the Service
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service to transmit malware, spam, or other harmful content
  • Resell, sublicense, or redistribute the Service without our written consent
  • Use automated means to scrape or extract data from the Service beyond what the Service provides through its intended interfaces

6. Customer Data

You retain all rights to the data you provide or connect to the Service (“Customer Data”). By using the Service, you grant us a limited license to process Customer Data solely to provide and improve the Service.

You are responsible for ensuring that you have the necessary rights and permissions to share Customer Data with the Service, and that your use complies with all applicable data protection laws.

7. Intellectual Property

The Service, including its design, features, code, and documentation, is owned by Oblik LLC and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or branding.

Content you create within the Service (posts, comments, dashboards) remains yours, subject to the license granted in Section 6.

8. Payment and Billing

Certain features of the Service require a paid subscription. By subscribing to a paid plan, you agree to pay the applicable fees as described at the time of purchase. Fees are non-refundable except as required by law or as otherwise stated in our refund policy.

We may change pricing with 30 days' notice. Continued use after a price change constitutes acceptance of the new pricing.

9. AI-Generated Content

The Service may generate insights, summaries, and recommendations using artificial intelligence. AI-generated content is provided for informational purposes only and should not be relied upon as the sole basis for business decisions. We do not guarantee the accuracy, completeness, or suitability of AI-generated content.

10. Third-Party Integrations

The Service may integrate with third-party platforms and data sources. Your use of third-party services is subject to their respective terms and policies. We are not responsible for the availability, accuracy, or practices of third-party services.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OBLIK LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR GOODWILL, ARISING OUT OF YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify and hold harmless Oblik LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

14. Termination

You may stop using the Service at any time. We may suspend or terminate your access to the Service at our discretion, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including intellectual property, limitation of liability, and indemnification) will survive.

15. Changes to These Terms

We may revise these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the “Last updated” date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to its conflict of law principles.
